Bombay high court has declared that there aren't any objectionable whatsapp chat on aryan Khan's whatsapp.
Aryan Khan was arrested and kept in custody for a few days for drug use before getting his bail a couple of weeks before. The 14-page bail ordered by bombay HC is now available. Bombay high court has declared that there's nothing objectionable on aryan Khan's whatsapp chat suggesting anything related to conspiracy thus concluding that there's no positive evidence of conspiracy against aryan Khan.
The bail also said that the confessional statements obtained from aryan Khan can be used only for investigation purpose and not to draw any inference. The order read that “After having gone through the Whats-App chats extracted from Applicant / Accused no. 1's (Aryan Khan) phone, nothing objectionable could be noticed to suggest that Applicant nos. 1 & 2 (Merchant) or all three applicants along with other Accused persons in the agreement have a meeting of minds and have hatched conspiracy committing the offense in question ”.
The court added that “This court is of the opinion that the claim put forth by the Respondent that Applicants should be considered to have the intention to commit an offense under the NDPS Act, having found in possession of commercial quantity, in the backdrop of case of hatching conspiracy is liable to be rejected ”.
