Supreme Court: Petition to sack Satyendra Jain and nawab malik, CJI to decide on the listing


Ministers Jain and Malik have been arrested in separate criminal cases. Both the leaders are currently in jail in judicial custody.



Public interest litigation has been filed in the supreme court demanding the sacking of jailed AAP government minister Satyendar Jain and Maharashtra's Nawab Malik. On this, the supreme court said on thursday that this petition will be placed before the bench of the Chief Justice. After that, it will be listed.

Ministers Jain and Malik were arrested in separate criminal cases. Both the leaders are currently in jail in judicial custody. On thursday, the matter was mentioned before the vacation bench of Justices CT ravikumar and Sudhanshu Dhulia, seeking an urgent hearing.


This PIL has been filed by Advocate ashwini Kumar Upadhyay through Advocate ashwini Kumar Dubey. has been filed. It has been demanded that the delhi and maharashtra governments should be directed to sack both the ministers. The petition states that a minister is not only a public servant but also an MLA. He should be temporarily removed from the post after two days of judicial custody like IAS officers and other public servants.

Upadhyay urged for an urgent hearing of the petition saying that the matter is a serious violation of Article 14 (equality before law) of the Constitution. The hearing bench said that the petition is likely to come up for hearing next week. Such cases will first be presented before the CJI, only then they are listed.


In the same petition, the supreme court has also been asked that being the custodian of the Constitution, it should direct the Law Commission to examine the election laws to make arrangements to comply with Article 14 in the right context of the public servants. The Law Commission should be asked to prepare a comprehensive report to maintain the dignity of ministers, legislators, and public servants.

The ED had arrested Satyendra Jain on May 30 in a money laundering case. Similarly, maharashtra minister nawab malik was arrested by the ED on february 23. He has been arrested in a case related to the purchase of properties of D Company.
