Freedom of expression by cursing the Prime Minister?



It is known that sharing on social media is getting more and more lately. That is.. Freedom of speech.. Freedom of expression has been properly questioned by the allahabad High Court. Recently, the gujarat police has registered a case against mumtaz Mansuri who made offensive comments against prime minister Narendra Modi and Union home minister amit shah on Facebook.


Objecting to this, mumtaz approached the allahabad High Court. Referring to freedom of speech which is a fundamental right, freedom of expression, he tried to justify his comments within that scope.


Responding to this, the allahabad high court made it clear that there are reasonable limits to these fundamental rights. At the same time, the plea to quash the FIR registered against him was rejected. With this, the police registered an FIR against him.

The high court has made key comments on this occasion that freedom of speech does not apply to those who insult the prime minister, Union Ministers, important persons in the government of India. A division bench consisting of high court judges Justice Ashwani Kumar Mishra and Justice Rajendra Kumar took up the inquiry on this petition and made key comments in response to the issues brought to their attention.


As part of the investigation of the case.. rejecting the argument of the petitioner to quash the FIR registered against him.. it is stated that he has been charged with an indictable offence.

It instructed the police to proceed legally in this case. A case has been registered under Section 504 of the IPC and Section 67 of the IT Act on the post with objectionable comments like 'dog' directed at the prime minister and other Union Ministers. These comments made by the division bench of allahabad high court should be a warning to those who wantonly indulge in social media.
