The President has called for a change in the electoral system for the appointment of judges and the promotion of grassroots judges to the supreme court through the All india Level Examination.


New Delhi: President Ramnath Kovind today said that the National Judicial Commission Act (NJAC Act), which existed in the country before the judges' collegium, has been re-discussed. 

The NJAC Act is a law that was repealed by the supreme court six years ago. Following this, the collegium only set up a system to select the judge. 


The President called for a change in the electoral system for the appointment of judges and the promotion of grassroots judges to the supreme court through the All india Level Examination. 

Kovind said reforms in the process of electing judges were a "relevant issue" and should be sought without compromising the independence of the judiciary. 


I am of the firm view that bargaining is not possible in the independence of the judiciary. 

Without diluting it at all, the President asked at a function to celebrate the 'Constitution Day' at Vigyan Bhavan, Can we find a better way to elect judges to the High Courts?


President Kovind said that All india Judicial service will be appointed that could select, nurture and develop the right talented Judges from all the levels and this reformation idea was not innovative.

I am confident that there will be better proposals to reform the judge electoral system. Ultimately, the aim is to strengthen the justice system, Kovind said. 


On october 16, 2015, the supreme court quashed the NJAC Act and related amendments introduced by the central government as unconstitutional. 


The NJAC was introduced by the central government to replace the existing collegial system for the appointment of judges to the High Courts. 


The Act provides for the appointment of judges by committee. But the Constitutional Bench found that this was a government encroachment on the powers of the judiciary.
