In the hathras rape-murder case, an Uttar Pradesh court on thursday found one individual guilty while clearing three others. According to Section 304 of the indian Criminal Code, the court found the primary accused guilty of culpable homicide that did not constitute murder. According to the court, the girl and her mother did not tell the physicians about the sexual assault when she was admitted to the hospital on september 14, 2020. A week after the victim was admitted to the hospital, on september 22, the first reference of a sexual assault was made. Medical examinations of the victim's samples revealed no evidence of sexual assault. The victim had a ligature mark on her neck, which the court determined was consistent with an attempt to strangle her, but it did not cause her to die.


The victim's injuries on his or her body were caused by a single assault, according to the court, and did not indicate an assault by several people. The court ruling states that medical evidence shows indirect blunt trauma caused injury to the cervical spine (neck) and its aftereffects. The victim's statements were "enhanced," the court claimed, because they differed from what she gave to the woman constable and doctors. The victim had made statements to journalists and taped films on september 14 but did not mention sexual assault, according to the court.
