What are the conditions for getting national party status in India?


There are three main conditions to be a national party. Apart from four lok sabha seats, any political party should get 6% votes in the Lok Sabha. Other than this, in the assembly elections, a total of 6% or more vote share was raised in 4 or more states. According to KJ Rao, an expert on the political rules of elections on this issue, after the cleanliness campaign of the election Commission, there are now about 400 political parties in the country, but out of these, only 8 have got the status of a national party.

What is AAP's logic?

AAP says that the party fulfils all the conditions to become a national party. AAP's counsel informed the court that it had made a representation to the commission on december 19, 2022. A reminder was e-mailed on march 15, 2023.

In Delhi, Punjab, Goa, and Gujarat, the AAP is acknowledged as state party.  It contested the gujarat elections in 2022 and submitted the details of votes polled there to the Commission and sought recognition as a national party as per section 6B of the Act.

AAP recently formed the government in Punjab, after which bhagwant mann became the Chief Minister. AAP is in government in delhi and Punjab. The party also contested elections in Goa, gujarat and chandigarh and secured substantial votes. For this reason, AAP is demanding the status of a national party.
