disqualification process clearly shows that the Speaker of the maharashtra Assembly is in contempt of the
court. The court has given him permission only to decide on disqualification (petitions). Taking statements
through the tribunal is a strategy to delay things. I welcome it. The maharashtra Assembly Speaker is acting
in a partisan manner. Earlier today, the supreme court had directed chief minister Eknath Shinde And
strongly reprimanded the maharashtra Assembly Speaker for the delay in deciding the disqualification
petition of several MLAs, saying the Speaker cannot thwart the orders of the apex court.
What did prithviraj Chavan say?
Former maharashtra chief minister prithviraj Chavan said that the supreme court has passed another strict
order against Speaker Narvekar, which clearly indicates that he is deliberately delaying the decision on Shiv
Sena split. This is the second time that the apex court has warned the Speaker for violating the Constitution.
Unfortunately, the supreme court cannot do anything. Chavan said the anti-defection law gives decision-
making powers to the Speaker, who is appointed by a political party and is a member of that party and he Is
bound to the interests of the political party to which he belongs.
Therefore, the anti-defection law as amended in the 10th Schedule 2003 is flawed from the beginning and
needs to be abolished completely. CJI has the authority to initiate proceedings against the Speaker. I don't
know whether the supreme court will use its inherent power to protect the Constitution and the rule of law,
he said. On september 18, the top court had directed the maharashtra Assembly Speaker to give a timeline for
the decision on disqualification. Narvekar had last month initiated the process to hear petitions filed by rival
shiv sena factions led by chief minister Eknath Shinde and his predecessor uddhav Thackeray.
