Himachal: CJ division bench has different opinion...

In the matter of resignation of independent MLAs in Himachal, two different opinions of the division bench have come to the fore. Chief Justice Justice M.S. Ramachandra Rao and Justice jyotsna Rewal Dua have different opinions. Now this case will also be heard by a third judge, who will be appointed by the Chief Justice. Hearing the petition of the three independent MLAs, Chief Justice Justice M.S. Ramachandra Rao was of the opinion that the court cannot give orders to any constitutional institution, while Judge jyotsna Rewal Dua has a different opinion in this regard.

However, Chief Justice M.S. Ramachandra Rao and Justice jyotsna Rewal Dua had an opinion on the demand that the resignation of independent MLAs cannot be accepted by the High Court. The three independent MLAs had demanded in the petition that the high court should accept their resignation.

Now the third judge will also hear the case

After hearing the entire case, Justice jyotsna Rewal Dua is of the opinion that the court should ask the assembly Speaker to set a time limit for accepting the resignation. Since, now after hearing this petition, the Chief Justice and Justice have different opinions. In such a situation, this matter will now go to the third judge. The new judge will be appointed by the Chief Justice to hear the case. This information was given by Anup Ratan, Advocate General, himachal pradesh Government, during a conversation with the media.
