14 year old had committed brutality...?

The bombay high court on monday allowed a 12-year-old rape victim to terminate her pregnancy. The court said that his safety and security is paramount. A bench of Justice sandeep Marne and Justice Neela Gokhale took note of the report submitted by the medical board recommending termination of pregnancy at 25 weeks. According to the petition filed by the girl's mother in the high court, the girl was allegedly raped by her 14-year-old brother and a case has been registered against him.

This is how it was revealed

Earlier this month, the girl had complained of stomach ache to her mother and when she was taken to the hospital, she was found to be pregnant. Then the girl revealed that when no one was at home, her elder brother used to forcefully have physical relations with her. He has also threatened him of dire consequences.

On the complaint of the mother, an FIR was registered against the son under the indian Penal Code and Protection of Children from Sexual Offenses (POCSO) Act and he was sent to a juvenile home. The bench said in its order that the girl was unaware of the fact that she was pregnant for a long time.

The medical board has clearly said that if the pregnancy continues, it will have a serious impact on the mental and physical health of the patient. The bench said that after the termination process, the hospital will provide counseling to the girl. It has also directed the hospital authorities to preserve appropriate tissue samples and dna samples of the fetus and send it to the investigating officer for the upcoming criminal trial.
