Despite the calcutta High Court's order, the CID of West bengal police has not handed over Shahjahan Shaikh, the main accused in the attack on Enforcement Directorate (ED) officials, to the Central Bureau of Investigation (CBI). The cbi team, accompanied by paramilitary forces, went to the CID office in kolkata to take Shahjahan Sheikh into custody, but the CID did not comply with the court order, leading the cbi to return empty-handed.
The trinamool congress (TMC) government in bengal, led by chief minister Mamata Banerjee, has approached the supreme court against the High Court's decision. The case is expected to be heard on Wednesday, march 6, 2024. The bengal government, represented by senior advocate abhishek Singhvi, sought an immediate hearing on tuesday before the bench of Justice sanjeev Khanna and Justice Dipankar Dutta.
This development comes as the ED attached assets worth Rs 12.78 crore belonging to Shahjahan Sheikh, including his apartment and land. The calcutta high court had issued an order on january 5, 2024, instructing the handover of the investigation into the attack on ED officers to the CBI. The court also directed the custody of Shahjahan Sheikh to be given to the cbi by 4:30 pm on the same day.
Both the ED and the West bengal government had approached the high court against the order on january 17. The ED advocated for a sole cbi investigation, while the state government insisted on the case being solely under the jurisdiction of the bengal police and rejected the idea of a joint Special Investigation Team (SIT).
