As a result of the growing practice of wife swapping, it has been noted that husbands are using their wives to achieve their goals and aspirations by asking them to attend to the physical demands of their superiors or bosses in order to gain promotions and other professional advantages.  Several cases demonstrate this. For example, in 2012, the wife of a Navy officer petitioned the supreme court, claiming that her husband's senior officer at INS kochi had approached her with an offer of wife swapping. When the husband rejected the offer, the senior officer allegedly threatened him.

In addition, Shubham Sonker's husband and five other Navy members were charged with sexual assault and physical and emotional abuse of his wife in a formal complaint.  According to the wife's accusations, there is a case of wife swapping.
 
According to Joseph Shine v. Union of india, 2018 sc 1676, adultery was decriminalized in india in 2018 as a violation of Article 14 (right to equality) and Article 21 (right to life and personal liberty).  In order to maintain discipline within the armed services, the Center ultimately petitioned the supreme court of india in january 2021 to retain adultery a felony in the military.

Gang rape, unnatural sexual relations, bribery, criminal intimidation, and aiding and abetting were all listed in the FIR.  Although sex rackets have been in kerala for a while, the widespread practice of wife swapping was unheard of; this is alarming because such patterns have never been discovered before.

CONCERNED LAWS IN INDIA
Since the practice of wife swapping is a relatively recent phenomenon in india, there is currently no law or statute that specifically addresses the offenses involved.  Certain crimes are covered by the indian Penal Code, including rape (section 376), gang rape (376D), sexual harassment (354A), outraging women's modesty (354), criminal intimidation (section 505), and unnatural sexual contact without consent (section 377). In addition, laws like the Domestic Violence Act of 2005 address financial, mental, physical, and sexual abuse, and section 4 of the Immoral Traffic (Prevention) Act of 1956 stipulates that anyone—including family members—who lives off of prostitution money faces penalties.

Other difficulties, such as voyeurism, stealthing (removing a condom during sexual activity without agreement), marital rape, STDs, mental and physical health disorders, etc., can also be associated with wife swapping.  Wife swapping also results in the objectification of women and their sexual exploitation, which is against Article 21 of the constitution as well as their fundamental rights under Articles 14 (Equality) and 15 (Prohibition of Discrimination on the basis of sex).
