The Madhubani court has sentenced two accused of gangraping and murdering an 8-year-old Mahadalit minor girl in Madhubani and sentenced them to death. In the case of gangrape and murder, both the accused were convicted under sections 366(A), 376(D), 302/34, 4/6 POCSO Act and 3(2)(V) SC/ST Act. The court sentenced both of them to death along with a fine of Rs 1 lakh 20 thousand. This case is related to a village in Jaynagar police station area.

What was the matter, when was the case registered?

On june 23, 2023, the father of the deceased girl, raj Kumar Saday, lodged a complaint at Jaynagar police station, in which he told that his 8-year-old daughter had disappeared while playing near the house. Even after the search, no clue of the girl was found, after which the police registered a case under sections 363, 366 (A), 302, 376 (DB), 201, 4/6 POCSO Act and SC/ST Act.

The investigating officer of the case, Inspector Gopal Krishna, arrested the primary accused Sushil Rai and co-accused Om Kumar Jha (father: munna Jha, resident: Sakin Parsa, Jaynagar, Madhubani). The accused were charged with kidnapping, gang rape, murder and hiding evidence of the girl.

What did the police recover and what action did they take?

The investigators told the court that the accused had killed the girl by strangulating her with a towel after gang raping her. The body of the girl was recovered from a room in the dilapidated Koshi Colony, hidden under a broken asbestos sheet. The police also seized the clothes of the accused from the scene of the incident, the mobile phone seized, blood-soaked soil and the red towel used in the murder as clues. All evidence was collected through forensic investigation and dna test. Statements of 18 witnesses were recorded in the court, on the basis of which charges were framed against the accused.
