Deepfakes are artificial, or phony, media that have been digitally altered to effectively swap out one person's likeness for another. Deep generative techniques are responsible for them. This cutting-edge wallet PLATFORM' target='_blank' title='digital-Latest Updates, Photos, Videos are a click away, CLICK NOW'>digital technology may successfully impersonate people in videos, raising worries about the dissemination of false information.
Furthermore, the right to privacy is severely threatened by the unauthorized use of technology.
This section places the responsibility for ensuring that an individual's privacy is safeguarded on social media sites, which function as intermediaries under IT Rules.
Furthermore, as per Rule 3(2)(b), an Intermediary is required to take all necessary steps to remove or disable access to any content that involves impersonation on an electronic platform, including images of individuals that have been artificially morphed, within a 24-hour period after receiving a complaint about it.
However, the law of defamation also poses special difficulties and concerns in the case of deepfake films, which are edited or created videos that frequently have a realistic appearance.
Even if the subject of the video never said or performed the things shown in it, deepfake films can be used to fabricate phony scenarios or remarks that seem to have been uttered by the subject. If certain conditions are satisfied, the aggrieved party in such a situation could be able to file a defamation action.
1. Falsity: The video must contain false information or portray the subject in a false light.
2. Publication: The video must be shown to a third party or made public in some way.
3. Harm: The subject must suffer harm to their reputation as a result of the false video.
4. Fault: In some cases, the plaintiff may need to prove that the video's creator acted negligently or with actual malice.
Under this rule, victims have remedies when deepfake films are created using illegal means such as hacking or data theft. Since these activities frequently entail unauthorized access to computer resources and may violate the protection of sensitive personal data, they are able to register complaints. A legal framework for addressing such offenses and pursuing remedies is provided under the Act.
