
The Uttar Pradesh government has filed an affidavit in the case of demolition of houses coming under the purview of road widening in Dalmandi area of varanasi and said that the petitioner will neither be evicted from the area nor his construction will be demolished until the land is acquired through voluntary transfer or compulsory acquisition or any other means.
A division bench of Justice Manoj Kumar Gupta and Justice Anish Kumar Gupta of allahabad High court, taking the reply of the state government on record, disposed of the writ petition filed by Shahnaz Parveen on May 20. Earlier, on May 9, the court had directed the parties to maintain status quo on the houses coming under the purview of Dalmandi road widening in Varanasi. Also, the court had sought a reply from the state government and the district administration in this matter within a week.

The counsel for the petitioners had argued that the state officials were threatening to demolish the houses without acquiring land and houses for road widening. In its May 9 order, the court had said, "Considering the argument of threat of demolition of houses without acquiring them, we direct the government to maintain status quo till the next date." According to the petitioners, about 189 houses in the Dal Mandi area will remain protected after this interim order of status quo.
The counsel had argued that the varanasi district administration is preparing a compensation report for all the houses. The Dal Mandi project is worth more than Rs 100 crore, so it requires cabinet approval. The report of the district administration will be sent to the state government. It is noteworthy that to make the route to kashi vishwanath temple smooth, the state government has decided to widen the Dal Mandi road connected to the new road going to Chowk by 17 meters. About 189 houses are coming under the purview of widening.
