With the beginning of the month of Sawan, one of the major religious pilgrimages of North India, 'Kanwar Yatra' has started from July 11. As soon as the Kanwar Yatra started, the politics of Uttar Pradesh and Uttarakhand has also heated up. In fact, in the last three to four days, many such incidents took place during the Kanwar yatra, when Kanwariyas vandalized the hotels and dhabas on the yatra route. During this, the Kanwariyas accused the Dhaba owners and Muslim businessmen of running the Dhaba by hiding their identity.

This is not the first time that such a controversy has come to the fore during the Kanwar Yatra. Earlier also, Muslim Dhaba operators have been accused of doing business with a Hindu name. Some cases have been proved and some turned out to be fake. In such a situation, the question is, is it illegal to be a Muslim and run a Dhaba with a Hindu name? And what does the law say in this matter?

Can a Muslim person run a Dhaba with a Hindu name?

According to the indian Constitution, any person has the right to do any kind of business. As far as hotels or Dhabas are concerned, a license is issued by the Food Department, in which the name of the hotel or Dhaba operator is written. It is mandatory for all hotel or Dhaba operators to have this license, so that it can be inspected if needed.

What does the law say?

According to indian law, it is not a crime for a person to run a business under another name. However, if this is being done deliberately to spread confusion in the society or to hurt someone's religious sentiments, then action can be taken against it. If this is done, action can be taken against the hotel or Dhaba operators under the indian Justice Code.

The supreme court has also imposed a ban

Last year, before the start of the Kanwar yatraan order was issued by the Uttar Pradesh, uttarakhand and madhya pradesh governmentsin which all the hotel or dhaba operators on the Kanwar yatra route were ordered to display their names and the names of the employees working at the hotels. The government said that this order was issued to ensure that there is no confusion among the Kanwar pilgrims and disputes can be avoided. However, the Supreme Court had stayed the order saying that the government cannot force any hotel or dhaba operator to display the nameif they want to do so voluntarily then they can do so.
