
Kapil Sibal Big Allegation: On the issue of extension of service to delhi Chief Secretary, the supreme court had
on wednesday said that the Center has the power to extend Kumar’s services for a period of six months. On
wednesday, the supreme court said that the Center has the power to extend Kumar’s services for a period of six
months. A bench headed by CJI DY Chandrachud had said in its order that we have come to the conclusion that
at this stage the decision of the central government to extend the services of the outgoing Chief Secretary for a
period of six months is not bound by law or the Central and NCT delhi Governments. This cannot be considered
a violation of the constitutional distribution of powers.
AAP government had given this argument
In the petition filed by the delhi government, it was argued that the Chief Secretary is always appointed by the
specially elected government. In the last hearing, the supreme court had asked the central government to give
a list of five senior bureaucrats to give a viable solution and the delhi government can choose one name from
those suggested by the Centre. It was said that by doing this the concerns of the central government would be
satisfied. Also, confidence in the officials of the elected branch of the state will increase to some extent.
