It is not a crime to establish a consensual relationship, the accused of rape is acquitted

Fatehabad Additional district and Sessions court has acquitted the accused while hearing a rape case. The verdict was handed down by a court headed by Justice Balwant Singh. The court clarified that a consensual relationship cannot be rape. The victim had been working in the accused's canteen for several months. It was mentioned in the charge sheet that the accused had given excuses for marriage even though he was married.

The victim claimed that it was the fault of the accused that he was married and showed the lure of marriage. The court cross-examined the woman in the case. Despite preconceived notions of whether the accused is married or not, the woman agreed to have sexual intercourse. The court said that the victim's behavior showed that her physical relationship with the accused was consensual. She then fabricated this story to record the crime!

Most importantly, on june 15, 2019, Tohana police filed a case against Dalip, a resident of Gilanwali Dhani. The case was registered under Sections 313, 328, 376, 506, and SC-ST Act of IPC on the complaint of the concerned woman.

She went to a school in search of a job. It was at this time that she met Dalip, a contractor for the school canteen.One day the two decided to meet. He fetched the juice and the victim fainted after drinking it. Dalip then raped her. For months afterward, he continued to rape her. She had an abortion after she became pregnant. After some time she asked for marriage. However, Dalip said that he was married.

Responding to the woman's allegations in court, the accused's wife also appeared and said that she had given the fridge to the victim in installments and also paid the installments herself.The landlord also testified in court. Once Duleep came into the room. However, he did not see Dalip again after that.

The court has made important observations in this case. When it was proved that the victim had a consensual relationship with the accused. The court then clarified that the medical evidence was not sufficient to substantiate the allegations. The court also said that although the semen of the accused was found on the victim's underwear, it was not proved that rape had taken place. The court has since acquitted the accused.
