According to the new bill, if a person wants to donate his property or assets to Waqf, then he can do it, but before donating, he will have to give a share to the women of his family. What is Waqf-Alal-Aulad?
Waqf-Alal-Aulad has been playing an important role in preserving wealth and supporting religious works for centuries. Waqf-alal-aulad means 'Waqf for the family'. This is also a type of Waqf, in which a Muslim person donates his property for the benefit of his family members, children and grandchildren. Its purpose is to ensure the financial security and responsibility of the family. For example, if there is any agricultural land, then the family should keep earning from it, or they should keep getting rent.
People used to misuse it
Apart from this, the donor can also include a provision in the Waqf deed to allocate a part of the income for religious purposes. This comes from Hanafi Islamic law and is valid under Muslim Personal Law in India. Waqf-alal-aulad has been misused many times by people. These people used to donate all their property to Waqf by depriving the women of their family of their rights and the women were left with nothing.
Why was the Waqf-Alal-Aulad amended?
In the new Waqf Bill, some provisions have been made regarding Waqf-Alal-Aulad, so that its misuse can be prevented and women and weaker sections can be financially protected. According to the new bill, before making any property a Waqf-Alal-Aulad, it will be necessary to give women such as wife, widow, daughters or orphans their share of inheritance. It can also be understood in this way that if a person has property worth 10 lakhs and he wants to give it in Waqf-Alal-Aulad, then it will be mandatory to first give 2 lakhs to his daughter. After this, a Waqf of 8 lakhs will be made.
