On Wednesday, IRB Infrastructure Developers Limited served the Deccan Chronicle newspaper with a legal letter, accusing it of publishing a defamatory story on the Outer Ring Road (ORR) lease. IRB Infrastructure Developers Limited also filed a complaint with the press Council of India. The publication received a similar legal warning from the hyderabad Metropolitan Development Authority (HMDA).

According to the hmda notification, the report headlined "ORR lease: IRB says it can't pay 10% advance of total bid" was untrue, without foundation, and wrong, and its contents were erroneous. The notification warned that the words in the newspaper might harm both the reputation of her client's organization (HMDA) and the State government as a whole.


The hmda stated that the alleged 10% advance of the total bid amount was not required by the terms of the tender, and that "the imputations made through news item were made with the intent to harm or knowing or having reasons to believe that such imputations/statements will harm the reputation of the HMDA." The warning said that if no news or correction was received within three days after confirming the facts stated in the notice, "the authorities will be forced to initiate appropriate legal proceedings, including the defamatory proceedings (civil and criminal) against you."

TRD Associates, advocates for their client IRB Infrastructure Developers Limited, submitted a legal complaint to Deccan Chronicle claiming that the news report was "false, baseless" and citing the identical set of tender criteria. It was noted that the aforementioned article was ex-facie defamatory and featured a number of unfounded and misleading claims.

The TRD Associates in the legal notice stated that the concessionaire was only obligated to pay the bid amount, or the concession fee, within 120 days of the execution of the concession agreement, or any extended date agreed upon by authority prior to the appointed date, after the concession agreement had been signed. As a result, the article's whole premise was demonstrably untrue.

IRB Infrastructure Developers Limited claimed in a letter to the press Council of india that the article was initially defamatory and contained several false and erroneous allegations with the intentional purpose to harm its goodwill and reputation.
