The series of constitutional crises arising in the Municipal Corporation of delhi (MCD) has not ended since the
mayor's election till now. The latest matter is regarding the budget of delhi Municipal Corporation (MCD
Budget 2024). The Standing Committee of the Corporation (MCD Standing Committee) has not been formed
yet. On the other hand, departmental officials have started preparations to make the budget (MCD Budget). In
such a situation, if a standing committee is not formed, then the situation is not clear at present regarding how
the corporation's budget will be presented.
Why conflict over MCD budget?
This question regarding the budget of MCD is because the Standing Committee has not been formed yet,
whereas more than nine months have passed since the MCD election results. It is worth noting that without the
Standing Committee the budget process will not begin. Whereas every year before 10th december the Municipal
Commissioner has to present the budget before the Standing Committee. In the absence of a standing committee,
this budget cannot be presented directly in the House. In such a situation, the Municipal Commissioner can
present the budget before the LG. As per rules, before doing this, MCD will also have to take the opinion of the
Union home Ministry. At present, the Chief Accountant cum Financial Advisor of MCD has issued an order
asking all the departments to submit the revised budget estimates for the financial year 2023-24 and budget
estimates for 2024-25 by september 15.
This is the reason for not forming a standing committee
Actually, there is no legal hurdle in forming the standing committee, but MCD is waiting for the order of the
Supreme Court. Mayor Dr Shaili Oberoi has challenged the nomination of the nominated members appointed by
the LG. The supreme court has not given its verdict on this. The corporation can form a standing committee
even without an order, but there is no consensus between bjp and AAP. Both feel that the decision of the top
court will come in their favor.
