Hearing was held in patna high court on thursday (April 24) in the case of reducing 10 percent reservation to economically backward class (EWS) in BPSC teacher recruitment. During this, the court has summoned the reply from BPSC and the government. A single bench of Justice Satyavrat Verma has given this order after hearing the petition filed by Abhay raj and others.
patna high court informed that Bihar Public service Commission had issued advertisement number 22/2024 last year for the recruitment of teachers in the schools of the state. In this, the 10 percent reservation fixed for economically backward class (EWS) was deliberately reduced. While the number of posts was to be 19842, it was reduced to 917 posts due to reduction of 10 percent.
What did the lawyer tell the court?
During the hearing in the court, senior advocate Abhinav told that earlier there were 21,771 posts. During that time, about 2000 posts were reserved for the Economically backward classes (EWS). In 2023, when the court declared 65 percent reservation unconstitutional, the seats were reduced to 19842. Along with this, it was decided to give reservation to 917 seats instead of 1984 EWS.
The next hearing of the case will be on june 23
It has also been told in the petition that reservation was given to women vertically. Whereas according to the Constitution, they should get reservation horizontally. Now june 23, 2025 has been given for the next hearing on this matter.
Instruction to file affidavit in 4 weeks
The state government and BPSC have been directed by the court to file an affidavit within four weeks in which it should be clarified on what basis the reservation for the EWS category has been cut. What is the justification of the vertical horizontal structure of reservation given to women in different categories.
