Every woman should know these Legal Rights of Mother?...


The law has given many rights to a mother. This includes rights ranging from the right to become a mother to the adoption of a child and property. Many times women become victims of exploitation due to lack of knowledge on these issues. In such a situation, correct information is very important.


Here are those 10 rights-

1. The fundamental duty to respect the mother/woman is enshrined in Article 51(e). There is a provision in this that it is the duty of every citizen of india to respect the mother / woman.


2. The first right of the mother is to give birth to the child. abortion cannot be done against the will of any pregnant woman. If someone does this, then she is considered guilty under Section-313 of the IPC.

3. The delhi High court has said that every child has the right to write his mother's surname. 


4. Every woman also has the right of adoption. She can adopt a child with the consent of her husband. She can adopt a child even if she is not married or if her husband is dead or she is divorced.

5. Our law does not give the right to take the child away from the mother against her will. If anyone does this then he will come under the category of cruelty and will be found guilty under section 498 (a) of the IPC.

6. If the children are not maintaining the mother properly, then she can go to the court under section 125 of CrPC. Through this act, the mother can take alimony from the children. 

7. If any child harass or harms or threatens the mother in any way, then the mother can file a complaint against him in the police station.

8. According to the Maternity Benefit Act 2017, a pregnant woman is eligible for 26 weeks of maternity leave. She can take this leave only for her two pregnancies. 

9. The mother also has a share in the ancestral property. She can use that part for herself. 

10. According to the Hindu Minority and Guardianship Act 1956, the father has the right to take care of the guardianship and property of the minor child, if the father is not there, then the law gives this right to the mother.
