
Union home minister amit shah has introduced the 130th Amendment Bill of the Constitution in the Parliament. This bill talks about removing everyone from the PM to the ministers from their posts after 30 days of arrest.
Congress mp manish Tiwari has stated that the three bills will be introduced in parliament by Union home minister amit Shah. The congress mp said on wednesday (August 20, 2025) that these three bills are against the basic structure of the Constitution of India. The Constitution of india says that you are innocent until your crime is proven. He said, 'You cannot make any investigating officer or SHO the boss of our Prime Minister.'
Congress mp manish Tewari said in the Lok Sabha, 'The basic structure of the Constitution of india says that there should be rule of law and the basis of that rule of law is that you are innocent even if your guilt is not proven.'
The bill violates Article 21 of the Constitution: Manish Tiwari
The congress mp said, 'This bill, introduced to amend the Constitution, violates Article 21 of the Constitution. Under which a person can be held guilty if the crimes are confirmed through FIR, arrest, charge sheet, and any other means.'
He said, 'This bill harms the democracy in parliament, which is included in the basic structure of the Constitution. This is an attempt to suppress the voice of the people.' He said, 'This bill also opens the doors for political abuse by the state institutions, whose arbitrary conduct has been repeatedly objected to by the supreme Court.'

He further said, 'This bill ignores all the existing constitutional safeguards of collective responsibility, judicial review, no-confidence motion, disqualification, and conviction. In such a situation, this bill, introduced by Union home minister amit shah to make the 130th amendment in the Constitution, becomes completely unnecessary and unconstitutional. Therefore, I strongly oppose these three bills and request that the home minister withdraw these three bills.
