Supreme court to Decide Real shiv sena and ncp Factions
Final Hearing Scheduled:
The supreme court of india has set january 21, 2026, for the final hearing on which factions are the legitimate shiv sena and NCP.
Cases will be heard together due to similar issues in both petitions.
Shiv Sena Dispute:
Parties Involved: shiv sena (UBT, led by uddhav Thackeray) vs. shiv sena (Eknath Shinde).
Issue: election commission (EC) recognized the Shinde faction as the official shiv sena and allotted it the "bow and arrow" symbol.

UBT Faction Argument:
EC did not properly test majority within the party.
Shinde faction’s strength among MLAs was allegedly overestimated.
Interim Relief: uddhav thackeray faction allowed to use Shiv Sena (UBT) name and burning torch symbol pending final decision.
Legal Representation: Senior advocates abhishek Manu Singhvi and Devadutt Kamat.
NCP Dispute:
Parties Involved: ncp (Sharad Pawar) vs. ncp (Ajit Pawar).
Issue: Election Commission allotted the “clock” symbol to ajit pawar in february 2024.
Sharad Pawar Faction Argument: Challenged the ec decision on legitimacy grounds.
Interim Relief: sharad pawar faction allowed to use man with a trumpet symbol; ajit pawar can campaign using the "clock" under the assumption the case is pending.
Legal Representation: Senior advocates mukul rohatgi and N.K. Kaul.
Supreme court Directions:
Bench of Justices surya Kant and Joymalya Bagchi recognized similarities in the two cases.
No other urgent matters to be listed on january 21 to allow extended hearing on january 22, if necessary.
Previous hearings adjourned, with next procedural update noted on november 12, 2025.
Background:
