22 march is World Water Day but have you ever wondered why the bottle of water which is available in shops outside for twenty rupees, is available at a higher price in big hotels and restaurants? Right to sell for more than the MRP

As per the supreme court ruling in 2017, restaurant and hotel owners are not bound by the maximum retail price or MRP in the case of packaged food or beverages. The government was the respondent in this case while the petition was filed by the Federation of Hotel and Restaurant Associations of india (FHRAI). The government said that selling pre-packaged food items at more than the MRP is a legal offense, which can lead to a fine of Rs 25,000 or a jail term.


Giving its decision, the Rohinton Nariman Bench of the supreme court, while giving its decision, made it clear that hotels and restaurants do not come under the JD of this crime. The supreme court had clarified that this is not a straightforward matter. No one goes to the hotel just to get one bottle of mineral water.


It is a crime to charge more than the MRP elsewhere

Packaged food and drink items in restaurants and hotels may cost more than the MRP, but as per Section 36 of the Legal Metrology Act, any item with a fixed price is considered to be more than the MRP. But selling is a crime. For the first time, a fine of Rs 25,000 can be imposed on the accused. Repeating this offense can increase the fine up to 50,000. Doing this repeatedly can be punished with a fine of one lakh rupees, one year in jail, or both.
