
The delhi high court has asked the central government to file a status report on rahul Gandhi's citizenship case. The delhi high court yesterday (Friday, 06 december 2024) has sought a response from the central government on the petition filed by bjp leader Subramanian Swamy on the issue related to the citizenship of leader of Opposition in lok sabha rahul Gandhi.
A bench of Acting Chief Justice Vibhu Bakhru and Justice Tushar Rao Gedela of the high court has directed the central government to file a status report on the petition. During the hearing, the lawyer appearing for the central government said that the lawyer who was looking into the matter was recently designated as senior advocate, so now the case has to be assigned to a new lawyer, after which the high court adjourned the case till january 13, 2025 on the request of the central government lawyer.

Subramanian Swamy's petition states that in august 2019, he wrote a letter to the home Ministry, in which a voluntary disclosure was made by rahul gandhi to the british government that he is a british citizen and is entitled to hold a british passport. Swamy has said in the petition that rahul gandhi, being a citizen of India, has violated the indian Citizenship Act as well as Article 9 of the indian Constitution.
What does Article 9 of the Constitution say?
Subramanian Swamy has claimed that if this disclosure is true then rahul gandhi will no longer be an indian citizen because Article 9 of the Constitution states that a person will not be considered a citizen of India. If he has acquired the citizenship of another country of his own free will. He has also sent several representations to the ministry to inquire about the status of his complaint, but neither any action has been taken on it nor has he been informed.
