
The supreme court (SC) has stayed the demolition of residential and commercial properties in Fatehpuri area of chandni Chowk in Delhi. A bench of Justice Suryakant and Justice N. Kotishwar Singh gave this order during the hearing on tuesday (May 13). sc also reprimanded the Municipal Corporation of delhi (MCD) for failing to stop illegal construction. According to PTI, the court said that if MCD does not file the status report on time, it will be considered that it is involved in collusion with the builders.
Ban on demolition of residential buildings and commercial complexes - SC
During the hearing, the court took cognizance of the photographs of the area presented by the intervener and said that the illegal construction of commercial complexes was not stopped by the MCD. sc issued clear instructions and said, "In the meantime, the demolition of residential buildings and construction and alteration of commercial complexes is banned." The court also said that if the report is not submitted, contempt proceedings will be initiated.
No trust in the report of MCD officials - supreme Court
The advocate appearing on behalf of MCD argued that after the court's order, the area was inspected and a complete report has been prepared, but due to holidays it could not be placed on record. The lawyer also claimed that all illegal constructions have been removed from the area. However, the court refused to trust the MCD report and expressed the need for independent inspection.
The court asked the petitioner to suggest the names of independent architects and civil engineers so that they can visit the spot and inspect and submit an unbiased report. The bench said, "Now we cannot trust the MCD report, so independent inspection is necessary." The supreme court has fixed May 23 as the next date of hearing of the case. Earlier on february 17, the court had also considered the possibility of getting the case investigated by the CBI.
