Calcutta high court Protects Jobs of 32,000 Primary teachers in West Bengal

Major Relief to Teachers

The calcutta high court has delivered a significant relief to primary school teachers in West Bengal.

A division bench overturned a single-judge bench decision that had previously cancelled the appointments of 32,000 teachers.

West bengal Chief minister Mamata Banerjee welcomed the order, calling it a "great relief" for the teachers and their families.

Division Bench Overturns Single-Judge Order

The division bench was headed by Justice Tapabrata Chakraborty.

The previous order, issued by single-judge Justice Abhijit Gangopadhyay on May 12, 2023, had terminated the teachers’ appointments.

The division bench noted that irregularities were not proven in all recruitments, making the cancellation of all appointments unjustified.

Background of Appointments

The 32,000 primary teachers were recruited through the Teacher Eligibility Test (TET) in 2014.

The cbi was directed by the high court to investigate alleged irregularities in the recruitment process.

Initially, the cbi identified 264 appointments with irregularities; 96 other cases were later scrutinized by the agency.

Impact of Termination

The court highlighted that terminating employment after nine years would have a severe adverse impact on teachers and their families.

Based on this, the division bench ruled that the entire recruitment process could not be cancelled.

Reactions from government Officials

Chief minister Mamata Banerjee emphasized the government’s intent to create jobs rather than take them away.

West bengal Higher education minister Bratya Basu congratulated the Board of Primary education and teachers, stating, "Truth has prevailed."

The court's decision ensures that the jobs of all 32,000 primary teachers remain secure.

Conclusion

The ruling preserves employment for thousands of educators in West bengal and restores stability for their families.

The judgment underscores the importance of verifying irregularities before canceling large-scale recruitments.
