The argument started when the woman protested the limitations placed on her freedom, social activities, and attire by her in-laws. She wanted to wear the clothes she loved, go to parties late at night, and drink things that her conservative husband and his family didn't appreciate. While the husband relocated to Pune, the woman stayed in bhopal with no hope of reunion.
Shail Awasthi, a family court counselor, claims that the woman first filed a case under Section 125 CrPC (maintenance) and Section 498A of the IPC (dowry harassment), both of which were dismissed. Later, when the husband filed for divorce, she petitioned the court under Section 9 of the Hindu marriage Act to restore their marital rights.
The woman now claims that only if she receives Rs 50 lakh will she submit to a divorce by mutual consent. Despite her husband's insistence that she work from home, she says she is currently unemployed.
"We regularly witness one spouse requesting money to resolve marital conflicts. According to Awasthi, "such demands are now quite common, but the amount depends on the economic status."
