It heard an appeal filed by a man whose divorce petition had been denied by a family court. The high court noted that the couple had not been together for a long period and that the wife had denied carrying out the "marital liability" requirement. 

The pair were wed in 1979, yet the wife's Gauna ceremony, as required by their community, wasn't held until seven years later. The wife moved back in with her parents after six months, and the pair haven't lived together since. The woman denied having any sexual interactions with anyone at the time. Later on, she wed another man. Before then, the couple divorced amicably in front of a panchayat. The man went to court and asked for a divorce on the grounds of domestic abuse and deserting his wife. 

At the family court, he was denied one due to harshness. He then appealed to the allahabad high court in response. The couple in question has been living separately, and the court noted that they could not be forced to remain bound in a failed marriage even if it was noted that delaying sex for a long period constituted mental cruelty.
