Nimisha Priya, a resident of Kerala, has been found guilty of murdering her business partner Talal Abdo Mahdi. A yemen court sentenced her to death in this case in 2018. How does blood money work in Sharia law?
The feeling of revenge in Sharia law is based on the Sharia law called Qisas. Which means death penalty in return for death. In the case of murder, this means that the victim's family can demand death as punishment for the offender. In Islamic Sharia law, blood money is also called diya. For example, in case of murder or any other serious crime, the accused pays financial compensation to the victim's family. According to Sharia law, there are two types of murder, one is intentional murder and the other is accidental murder. According to Sharia law, in case of intentional murder, the punishment is death or whatever punishment is applicable according to the manner in which the crime was committed.
If the murder is accidental, then according to the verse (4:92), the punishment is ransom i.e. blood money. But if the heirs of the person who has died waive the punishment of their own free will, then they are allowed to do so. In such a case, it is the duty of the murderer to follow the agreed amount and pay it in a proper manner. According to scholars, the idea behind this is to promote forgiveness and provide reparative justice to the victim's family.
When did blood money work before?
Earlier, a death case against a criminal was dropped, but he was kept in jail after the payment of diya. One such example is the case of Abdul Rahim from Kerala. He was convicted in saudi arabia for the death of his employer's son. Rahim was pardoned by the victim's family after paying a huge amount. However, even after this, his case was not closed and he was sentenced to 20 years in prison. However, since he had been in jail earlier in this case, his time was taken into consideration. The crime took place in 2006 and he was pardoned in 2018. Even after this, he was released the very next year.
