Kapil Sibal: 'Government is protecting Judge Shekhar Yadav', Sibal criticized Dhankhar for inaction on impeachment notice


Rajya Sabha member kapil sibal on tuesday questioned why Chairman jagdeep dhankhar did not take any action on the notice to bring an impeachment motion against allahabad high court judge Justice Shekhar Kumar Yadav. He alleged that the government is trying to save the judge who made completely communal remarks last year.


Senior lawyer Sibal said that the whole incident smells of discrimination, as on one hand, the rajya sabha Secretariat had written a letter to the Chief Justice (CJI) not to conduct an internal inquiry against Yadav, as a petition was pending against him in the Upper house of Parliament. While this was not done in the case of Justice Yashwant Verma.

Sibal also said that if the government tries to remove Verma without impeachment, citing the supreme Court's internal investigation against him, as claimed in some reports, it would be unconstitutional and would be strongly opposed for endangering judicial independence. In the month of March, there was an incident of arson at Verma's house in the national capital. He was then a judge of the delhi High Court. During the arson incident, several burnt sacks of notes were recovered from his house.


In the case of Justice Yadav, Sibal saidit is very unfortunate and when a person sitting on a constitutional post does not fulfill constitutional obligations in six months, it is natural for questions to arise. Addressing a press conference here, Sibal said, we had given notice of impeachment motion to the Chairman of the rajya sabha on 13 december 2024. It was signed by 55 MPs. Six months have passed, but no action has been taken.


He said, I want to ask the people sitting on constitutional posts that their responsibility is only to check whether the signatures are there or notshould it take six months? Another question arises as to whether this government is trying to save Shekhar Yadav. He said that on the instructions of vishwa Hindu Parishad (VHP), Yadav gave a speech in the high court campus and then the matter reached the supreme court, which took action. Sibal said Yadav was questioned in Delhi. A report was also sought from the Chief Justice of allahabad High Court. I have heard that the Chief Justice of allahabad high court gave a negative report and meanwhile, on 13 february 2025, the Speaker said that this matter should be seen constitutionally and parliament can take it forward.
