In this case, the supreme court asked the mumbai Police Commissioner to issue notice to these influencers so that they could appear in court. Otherwise, punitive action will be taken against them.


'India's Got Latent' host Samay Raina has been accused by an NGO of making fun of people suffering from a rare disease called 'spinal muscular atrophy' on his show. After this allegation, a bench of Justice Suryakant and N Kotishwar Singh asked the mumbai Police Commissioner to issue notice to the five influencers and make them appear in court. The bench also said that if they do not appear in court, punitive action will be taken against them.

The bench has also sought the assistance of Attorney General R Venkataramani on the PIL filed by the NGO 'Cure SMA Foundation of India'. The bench has sought this assistance to control social media content related to disabled people and persons suffering from rare disorders. At the same time, the bench has termed the influencers who make fun of such people as harmful and demoralizing. He also said that some serious corrective and punitive action is needed so that such things do not happen again.


The bench told senior advocate aparajita Singh, appearing for the NGO, "This is very harmful and demoralizing. Some laws try to bring the disabled into the mainstream and one incident ruins the whole effort. You should think of some corrective and punitive action within the law." The bench said that no one can be allowed to be insulted under the guise of the fundamental right to freedom of expression. The bench considered making guidelines on social media content related to the disabled. The NGO cited shortcomings in the existing legal framework and also urged the bench to prepare guidelines on online content.
