
Supreme Court: 'No concession will be given', Supreme court rejects appeal of convicts of raping a minor
The supreme court on wednesday rejected the appeal challenging the life imprisonment sentence of the convicts of raping a minor girl. The court said that this is a very serious matter. No concession will be given.
A bench of Justice prashant kumar Mishra and Justice manmohan on tuesday rejected the appeal of convicts Sanjay Paikra and Pushpam Yadav against the decision of the chhattisgarh High Court. Rejecting the appeal of the two convicts, the bench said that this is a very serious matter. You, along with the van driver, kidnapped a minor schoolgirl and raped her. We do not need any kind of concession in this. It is rejected.
The bench did not agree with the argument that the girl had consent and when she was kept in solitary confinement, she did not make any noise during that time. The bench said that she was a minor. This has been proved and now nothing else is needed.
On august 5, 2024, the high court upheld the trial court's verdict convicting Paikra, Yadav, and the third accused santosh kumar Gupta, a school van driver, for the offense of kidnapping and raping a seventh grader in the 2019 kidnapping and rape case. Earlier, the trial court had convicted the three accused on october 5, 2021. Apart from life imprisonment, the court had also imposed a fine of Rs 1,000 on them.
