The bench allowed the election commission to consider the petition made by the present chief minister Eknath Shinde to recognize his party as the original Shiv Sena. The court made it clear that the election commission will decide who is the real shiv sena in the thackeray and Shinde factions.
It is known that the coalition government which was in power until then collapsed due to Eknath Shinde's revolt in maharashtra Shiv Sena. After that Shinde formed the government with the support of the Bharatiya Janata Party. Later, the Shinde faction approached the election commission claiming that they are the original Shiv Sena. The thackeray faction opposed the party's demand to allocate the bow and arrow as the election symbol.
Thackeray asked the ec not to take any further action as petitions were pending in the supreme court on various matters related to political parties. But Thackeray's plea was set aside by the EC. The ec directed both groups to submit documents to prove that the bow-and-arrow symbol is yours. Along with the legislative side, It has also been clarified that letters of support from members of the party's organizational unit should be given.
