rohini Court has sentenced a private security guard convicted of repeatedly raping a minor girl to 20 years of rigorous imprisonment under the POCSO Act. The court said in its verdict that giving less punishment to the culprit in such crimes can undermine the effectiveness of the justice system. This verdict was given by Additional Sessions Judge Sushil bala Dagar. The accused was convicted of rape and aggravated sexual abuse under Section 6 of POCSO earlier this month.

The public prosecutor presented an important argument in the court and said that the crime of the accused has a deep impact on the society, so he should be given a harsh punishment. Special Public Prosecutor Yogita kaushik Dahiya in rohini Court argued that the accused has committed serious and inhuman crimes like kidnapping, repeated sexual abuse and threatening the victim. In such a situation, no leniency should be shown towards him.

The court cited old decisions of the supreme court in the decision

In the court's decision, the court cited a 2015 supreme court decision saying that unnecessary sympathy shown by giving less punishment to the convict not only harms the justice system but also undermines the public's faith in the law. Apart from this, the court cited another supreme court decision of 2006 saying that aspects such as the severity of the crime, the age and condition of the victim, the conduct of the convict and socio-economic background should also be taken into account while deciding the sentence.

The court ordered relief and rehabilitation assistance to the victim.

Considering all the facts, the court ordered a compensation of Rs 10.5 lakh to the victim as rehabilitation assistance. The case came to light in 2021, when the victim's family lodged a complaint with the police. Investigation revealed that the accused had kidnapped the victim and tortured her physically and mentally for a long time.
