donald trump on
saturday strongly countered the court's decision, which declared most of his tariff policy illegal.
trump said that his tariff policy remains intact and he will challenge the matter in the
supreme Court.
Trump wrote on social media, 'All tariffs are still in place! A biased
court wrongly said that our tariffs should be removed, but ultimately America will win.' He warned that if the tariffs are removed, it will be a "complete disaster" for the country, which will weaken America economically.
'Tariffs are the weapon of power'
Trump said that America will no longer tolerate huge trade deficits and unfair policies of other countries. He said, 'On Labor Day weekend, we should remember that tariffs are the biggest weapon for our
workers and companies making 'Made in America' products. With the help of the
supreme court, we will use them in the interest of the country and make America strong again.'
'The President took steps beyond his authority'
The Washington DC-based US
court of Appeals for the Federal Circuit said in its order that
trump exceeded his authority by imposing tariffs citing emergency powers. The
court said, 'The law allows the President to take many steps in an emergency, but this does not include the power to impose tariffs or taxes.' With this decision, the reciprocal tariffs imposed in
april and some duties imposed on China,
canada and
mexico in
february have been canceled. However, other tariffs imposed on steel and aluminum will not be affected.
Trump justified these tariffs under the
international Emergency Economic Powers Act (IEEPA) of 1977. This law is usually used to freeze assets or impose sanctions in an emergency.
trump was the first president to impose tariffs under this law.
The
court said that
congress had never intended to give the President the power to impose unlimited tariffs. The decision came on a petition filed by five small American businesses and 12 Democrat-ruled states, which argued that under the Constitution, only
congress, not the president, has the power to impose tariffs.
