A judge in Los Angeles denied Harvey Weinstein's request to dismiss two counts of sexual assault against a woman. The defence's argument that an alleged rape and forced oral copulation of a lady in a hotel room between 2004 and 2005 was beyond the statute of limitations was rejected by Judge Lisa Lench. Weinstein, who had previously been convicted of rape in New York, was extradited to california last week, where he formerly ruled the film business.

However, in 2010, the court upheld a similar defence position regarding a sexual violence accusation against another woman, requiring prosecutors to modify their case before it could proceed.
Following Thursday's hearing, Weinstein's lawyer, Mark Werksman, told reporters outside the court that "one-fifth of the prosecution's case has been shredded."
A pretrial hearing has been scheduled on september 13 in this case.

In 2017, many claims of sexual assault and harassment against Weinstein erupted, sparking the global #MeToo movement. Weinstein has stated that all of his sexual interactions were voluntary.
