Supreme court of india Directs Petitioners to Approach Gauhati high court First in assam cm Video Case
The supreme court of india took a firm stance while hearing petitions seeking action against assam chief minister Himanta Biswa Sarma over an alleged viral video controversy.
The court declined to entertain the petitions directly and questioned why the petitioners had not first approached the Gauhati High Court.
A bench comprising Justice surya Kant, Justice Joymalya Bagchi, and Justice vipul M. Pancholi observed that bypassing High Courts and directly moving the Supreme court in election-related matters is becoming a concerning trend.
The bench remarked that litigants should not undermine the jurisdiction of the High Courts and emphasized the importance of maintaining judicial hierarchy.

The supreme court advised the petitioners to present their grievances before the Gauhati high court, which has the appropriate jurisdiction to examine the matter.
Additionally, the apex court requested the Chief Justice of the Gauhati high court to ensure an expeditious hearing of the case.
During arguments, senior advocate abhishek Manu Singhvi contended that the seriousness of the allegations warranted intervention by the supreme Court.
Singhvi argued that the chief minister had allegedly made controversial remarks repeatedly, and the gravity of the situation justified urgent judicial scrutiny.
The supreme court, however, observed that with the assam Assembly elections approaching, political disputes are increasingly being brought before the judiciary.
The bench cautioned political parties and leaders to maintain constitutional decorum and restraint, especially during election season.
The controversy stems from a video shared on february 7 via the official social media handle of the bharatiya janata party assam unit.
In the video, the chief minister was allegedly seen aiming a rifle toward members of a particular community, triggering widespread protests and political backlash.
Following the outrage, the post was reportedly removed from social media platforms.
Separate petitions have been filed by leaders associated with the party OF INDIA' target='_blank' title='communist party of india-Latest Updates, Photos, Videos are a click away, CLICK NOW'>communist party of india (Marxist) and the Communist party of India.
The petitioners have demanded the registration of an FIR against the chief minister and the constitution of a Special Investigation Team (SIT).
CPI leader Annie raja has also called for an impartial investigation into allegations of inciting hatred.
The matter will now proceed before the Gauhati high court, where further legal examination is expected.
