The supreme court has said an important thing about the Aadhaar card. While hearing the SIR going on in Bihar, the supreme court has commented that it cannot be presented as a proof of citizenship. In such a situation, the question arises whether Aadhaar card is sufficient to prove indian citizenship, what does the Aadhaar Act of 2016 say? So let us first know what is Aadhaar card.
What is Aadhaar card?
Aadhaar card is a 12-digit unique identification card issued by the government of India. It is made by the unique identification authority of india i.e. UIDAI. It includes biometric data such as the person's name, date of birth, address, fingerprint and eye scanning. The main purpose of Aadhaar is to give people an identity, so that the benefits of government schemes reach the right person.
What is the whole matter?
Actually, the election commission has refused to accept Aadhaar card as proof of citizenship in Bihar. Due to which the names of 65 lakh people were removed from the voter list. RJD had filed a petition in the supreme court against this. On which the supreme court has made this important comment during the hearing.
What is in Section 9 of Aadhaar Act 2016?
According to the law, Aadhaar card is only a proof of identity and address and not of citizenship. Section 9 of the Aadhaar Act 2016 clearly states that Aadhaar number or its authentication does not give any person the right to citizenship or residence. This means that having an Aadhaar card does not prove that a person is a citizen of India. A five-judge bench of the supreme court also said in the Puttaswamy case of 2018 that Aadhaar is not proof of citizenship. Recently, the supreme court reiterated that Aadhaar cannot be accepted as a proof of citizenship, especially for registering name in the voter list of Bihar.
So how is citizenship proved?
To prove citizenship in india, certain documents are required, such as passport, birth certificate or residence certificate. These documents clearly confirm that a person is an indian citizen. But documents like Aadhaar, Voter ID, PAN card or ration card are not considered proof of citizenship, because they are only for identification and address.
