The bombay high court is hearing a petition filed by four law students appearing in person, who have challenged the holiday declared by the state government. It has been claimed in the petition that this holiday declared by the state government is arbitrary and it is not within the power of the state government to declare such a holiday. The petitioners had applied to the Registrar of the high court demanding formation of a special bench for immediate hearing.

Who are those four students?

According to Bar and Bench, a special bench of Justices GS Kulkarni and Neela Gokhale has been constituted to hear the petition on january 21, 2024. The petitioners, Shivangi Agarwal, Satyajit Salve, Vedant Agarwal, Khushi Bangia, are students studying law at maharashtra National Law university (MNLU), government Law college (GLC), mumbai and Nirma Law university, Gujarat. He has demanded the cancellation of the notification issued by the maharashtra government on january 19.

The petitioners claimed that declaring a public holiday would lead to "loss of education if educational institutions are closed, financial loss if banking institutions are closed, and loss of governance and public functions if government and public offices are closed". The PIL claimed that declaring a holiday to celebrate the consecration of the ram temple is “nothing more than incurring expenditure from the public exchequer for religious purposes, which is prohibited under Article 27 of the Constitution (prohibition of imposing any religion on any person).” Taxes cannot be imposed for promoting or maintaining a religious institution) is expressly prohibited by.
