
'Kulbhushan Jadhav has no right to appeal', shocking claim...
A shocking statement has come to the fore in the supreme court of pakistan regarding indian citizen Kulbhushan Jadhav. Pakistan's Defense Ministry lawyer Khwaja Haris ahmed said that Kulbhushan Jadhav was not given the right to appeal despite the decision of the international court of Justice (ICJ), as the ICJ had only ordered "consular access".
In fact, this comment came when a constitutional bench of the Pak supreme court was hearing the cases in which the accused of the May 2023 riots were convicted by Pakistani military courts. Jadhav's case was raised in this context, to show that the rights given to him are not being given to local citizens.
ICJ had asked pakistan to reconsider
Indian citizen Kulbhushan Jadhav, who is imprisoned in pakistan on charges of espionage, has not been allowed to appeal till now. In june 2019, the international court of Justice (ICJ) ruled in India's favour and said that pakistan should reconsider Mr Jadhav's conviction and death sentence. He should also be allowed to meet indian officials.
India says that pakistan did not fully comply with the ICJ's instructions. In July 2020, india clearly stated that pakistan has refused to implement the ICJ's decision. india also alleged that the trial given by pakistan was completely devoid of transparency and sense of justice.
Jadhav case mentioned in Pak supreme Court
Pakistani lawyer Khawaja Haris ahmed mentioned the Jadhav case during the hearing of a case in the supreme Court. The lawyer argued that the right to appeal given to Jadhav was not given to its own citizens who have been convicted by military courts for participating in the "Black Day" riots of 9 May 2023.
According to Dawn newspaper, Pakistan's Attorney General Mansoor Usman Awan has sought time from the court to consider the issue of giving the right of appeal to the riot convicts. This raises the question whether Pakistan is applying the rules differently for foreign nationals due to international pressure?
