The madras high court has quashed the central government's notification banning the import of dogs from foreign countries for commercial use.

In april 2016, in a notification issued by the director General of the Department of Foreign Trade, in order to protect domestic dog breeds, importation of dogs for commercial use from foreign countries was prohibited. The Kennel Club of India, madras Canine Club and balakrishna Bhat filed a case in the madras high court against this notification.

In the petitions, they had demanded that "this notification has been issued in the absence of any scientific study and statistics showing that domestic dogs are affected by the importation of foreign dogs".

In the order issued by Judge Anita Sumant, who heard the case, permission is given only after isolation and testing of dogs imported from abroad. There is no justification in the central government's claim that domestic dogs can spread diseases. There is no doubt that measures should be taken to protect indian dogs. Banning the importation of foreign dogs will not achieve that goal. On the other hand, he ordered to cancel the central government's notification saying that the commercial import of dogs can be regularized.

Accepting the explanation given by the tamil Nadu government that it is consulting with the tamil Animal Welfare Board and the tamil Nadu Veterinary university regarding the breeding of dogs, the judge ordered that the rules regarding the breeding of dogs should be formulated within 8 weeks. The judge has mentioned in the order that the court should be informed about the execution of this order on august 5.
