Today's decision, if wrong, congress will appeal to the SC?

After the supreme court stayed the 2-year jail sentence imposed on former congress National President rahul gandhi in the Modi surname defamation case, there is curiosity whether the order to restore his lok sabha membership will come out today.

Why further delay in decision?

There is no time limit for the Speaker of the lok sabha to decide on reinstatement. Earlier, ineligible mp Faizal from lakshadweep had also sought reinstatement. Faisal's membership was reinstated two months after he applied. The membership was restored after going to the supreme court questioning the delay. Will a decision on Rahul's reinstatement be taken quickly? There is still no clear picture on whether or not there will be a delay.

After the supreme court stayed the 2-year jail sentence imposed on former congress National President rahul gandhi in the case of defamation of the Modi surname, the house is curious whether the order to restore his lok sabha membership will come out today. The General Secretary of the lok sabha issued an order disqualifying rahul gandhi from membership the day after the surat court ruled that rahul was guilty. The congress party had demanded on saturday that the punishment should be canceled as soon as the disqualification has been suspended. There was no development as there was a holiday on Sunday. parliament session will start again on monday, and it is said that there is a possibility that an order will be issued canceling the order disqualifying rahul from the wayanad lok sabha constituency in Kerala.

However, the disqualification of lakshadweep mp PP Muhammad Faizal was canceled two months after the court stayed the punishment. That too Faisal moved the supreme court and his disqualification was canceled before it came up for hearing. Therefore, it is said that congress leaders are ready to approach the supreme court again on monday if there is any indication of such a delay in Rahul's case.

The debate against the no-confidence motion presented by the opposition parties against the government will begin in the lok sabha from Tuesday, and Modi will give his reply on august 10. So, till then Rahul's disqualification issue will be postponed or the order will be issued on monday itself. During the 2019 lok sabha election campaign, rahul gandhi during his speech in Kolar (Rahul Kolar Speech) questioned that all those with the surname Modi are thieves. Former gujarat mla Purnesh Modi had filed a defamation case against it. rahul was sentenced to 2 years in jail in that case. In this background, his membership of parliament has been cancelled.

rahul had asked during an election rally held in Kolar, karnataka in 2019 that all those with the surname Modi are thieves. BJP's Purnesh Modi, a former mla from gujarat, had filed a criminal defamation case saying that this was an insult to the Modi community. On march 23, the court that had investigated the matter had convicted rahul and sentenced him to 2 years in prison. But the execution of the sentence was stayed to enable the appeal to be filed.

Later, rahul gandhi approached the high court seeking a stay on the sentence, but was defeated there. Later, rahul moved the supreme Court. A three-judge bench of the supreme court stayed the sentence saying that the trial court judge had not given a reason as to why rahul gandhi was sentenced to the maximum sentence in the defamation case.
