What was Article 370? All you need to know...


Article 370 was a provision of the indian Constitution which gave special status to Jammu and Kashmir. This article also limited the applicability of the indian Constitution in Jammu and Kashmir. It was also mentioned in this article that the indian Parliament has the powers to make laws in this state only related to foreign affairs, defence and communications. article 370 also had limits on how it could be amended.

Let us tell you that article 370 was added to the Constitution by prime minister Jawaharlal Nehru and Sheikh Mohammad Abdullah after 5 months of talks. There were 75 members in this assembly and these people were assigned the task of preparing a separate draft of the Constitution of Jammu and Kashmir. This work was exactly the same as the Constituent assembly of india had prepared the draft of the indian Constitution.

The existence of this assembly also ended in the month of November 1956 after the adoption of the state constitution. bharatiya janata party had been considering this article for a long time as a thorn in the side of Kashmir's integration with India. This party had also mentioned in its manifesto that it would remove Articles 370 and 35A from the indian Constitution.

Due to article 370, only Article 1 of the indian Constitution (India is a union of states) was applicable in Jammu and Kashmir.

Due to this article, the President of india did not have the right to abrogate the constitution of the state.

Due to article 370, the flag of kashmir - SRINAGAR/JAMMU' target='_blank' title='jammu and kashmir-Latest Updates, Photos, Videos are a click away, CLICK NOW'>jammu and kashmir was also separate and along with this, the tenure of the Legislative assembly here was also of 6 years. Because of this article, the President of india could not impose economic emergency in Jammu and Kashmir.
