The issue of female prisoners getting pregnant while in jail has sparked significant concern and debate, leading to a public interest litigation filed in the calcutta High Court. The court, expressing deep concern over the matter, has appointed an amicus curiae to investigate and provide a report on the situation in West Bengal's jails.


The amicus curiae, after examining various jails in the state, revealed that 196 children have been born to women prisoners while in custody. This revelation has intensified the seriousness of the issue, prompting the calcutta High court to respond critically. The court has acknowledged the gravity of the situation and raised concerns about women inmates getting pregnant and giving birth in prisons.


In response to the findings, the amicus curiae proposed a complete ban on the entry of male employees into the enclosures and correction homes where predominantly women prisoners are housed. This suggestion aims to address the root cause of the problem and prevent such incidents in the future.


The High court, considering the issue as a serious matter, has taken steps to transfer the case to the bench that handles criminal cases.
